The DMH Stallard Employment Group works with a large number of clients within the banking and financial sectors including banks, investment banks, investment managers, hedge funds, commodity futures brokers and dealers, independent financial advisers, insurance companies and individuals.

Our team is familiar with the standards of conduct which apply and the issues and pressures which arise in a regulated environment and we apply our technical legal expertise in that commercial context.

Matters on which we have advised in the banking and financial sectors include the outsourcing of call centres, compliance, bonus disputes, business transfers, restructurings, start ups redundancies, collective consultations and the harmonisation of terms of employment. We draft terms and conditions of employment and related policies and give strategic employment advice. We have advised on issues arising from within bank branches, credit card operations, retail finance operations and call centres.

We have advised on sector specific issues such as fraud investigations (and the resulting disciplinary proceedings) and investigations by regulators and exchanges. These matters have included allegations of churning, front-running, trading without authority, misuse of error accounts, manipulation of demographic data, mis-selling of insurance through packaging and misappropriation of client funds. We have experience of matters involving the trading of equities, debt, commodity futures, financial futures, options, bonds and other financial instruments.

We conduct numerous Employment Tribunal cases, frequently without Counsel. Our recent past cases include: 

  • A multi party case concerning the obligation to consult with employee representatives under TUPE in connection with several hundred employees. 
  • Sex discrimination, race discrimination, disability discrimination and sexual orientation discrimination cases. 
  • Successfully defending unfair dismissal claims arising in connection with the harmonisation of terms and conditions of employment.
